Massachusetts Man Charged with Plotting Attack on Pentagon and U.S. Capitol and Attempting to Provide Material Support to a Foreign Terrorist Organization
Public Was Not in Danger from Explosive Devices, Which Were Controlled by Undercover FBI Employees

BOSTON- A 26-year-old Ashland man was arrested and charged today in connection with his plot to damage or destroy the Pentagon and U.S. Capitol, using large remote controlled aircraft filled with C-4 plastic explosives. Rezwan Ferdaus, a U.S. citizen, was also charged with attempting to provide material support and resources to a foreign terrorist organization, specifically to al Qaeda, in order to carry out attacks on U.S. soldiers stationed overseas.

“Our top priority is to protect our nation from terrorism and national security threats. The conduct alleged today shows that Mr. Ferdaus had long planned to commit violent acts against our country, including attacks on the Pentagon and our nation’s Capitol. Thanks to the diligence of the FBI and our many other law enforcement partners, that plan was thwarted,” said U.S. Attorney Carmen M. Ortiz. “I want the public to understand that Mr. Ferdaus’ conduct, as alleged in the complaint, is not reflective of a particular culture, community, or religion,” she added. “In addition to protecting our citizens from the threats and violence alleged today, we also have an obligation to protect members of every community, race, and religion against violence and other unlawful conduct.”

The public was never in danger from the explosive devices, which were controlled by undercover FBI employees (UCs). The defendant was closely monitored as his alleged plot developed and the UCs were in frequent contact with him.

Richard DesLauriers, Special Agent in Charge of the FBI’s Boston Division said, “Today’s arrest was the culmination of an investigation forged through strong relationships among various Massachusetts law enforcement agencies to detect, deter, and prevent terrorism. Each of the more than 30 federal, state, and local agencies on the FBI’s Joint Terrorism Task Force (JTTF) worked together to protect the community from this threat. In this particular investigation, the Worcester, Ashland, and Framingham Police Departments and the Bureau of Alcohol, Tobacco, Firearms, and Explosives, played particularly critical roles. The communities of Worcester, Ashland, and Framingham should be proud of the unwavering commitment and professionalism the agencies demonstrated in ensuring that their towns and region were safe from harm. The Massachusetts State Police and the Commonwealth Fusion Center also contributed significantly to this investigation.”

“The FBI used an undercover operation to conduct this investigation. Undercover operations are used to combat all types of crimes and criminals, including in the counterterrorism arena.”

“The JTTF initiated this investigation because we have an obligation to take action to protect the public whenever an individual expresses a desire to commit violence. A committed individual, even one with no direct connections to, or formal training from, an international terrorist organization, can pose a serious danger to the community,” added DesLauriers. “It is important to remember that our system of justice is based on the notion of individual responsibility. Therefore, no one should cite Mr. Ferdaus’ actions as an excuse or reason to engage in any unlawful behavior against others in the community. We will work diligently to protect the civil rights of all Americans.”

The affidavit alleges the following: Ferdaus, a Northeastern University graduate with a degree in physics, began planning to commit a violent “jihad” against the U.S. in early 2010. He obtained mobile phones, each of which he modified to act as an electrical switch for an IED. He then supplied the phones to FBI UCs, who he believed to be members of, or recruiters for, al Qaeda. According to the affidavit, Ferdaus believed that the devices would be used to kill American soldiers overseas. During a June 2011 meeting, he appeared gratified when he was told that his first phone detonation device had killed three U.S. soldiers and injured four or five others in Iraq. Ferdaus responded, “That was exactly what I wanted.”

According to the affidavit, after each subsequent delivery, Ferdaus was anxious to know how well each of his detonation devices had worked and how many Americans they had killed. During recorded conversations, Ferdaus stated that he devised the idea of attacking the Pentagon long before he met with the government’s cooperating witness (CW) and UC, and that his jihad had, “started last year.”

In recorded conversations with the CW that began in January 2011, Ferdaus stated that he planned to attack the Pentagon using aircraft similar to “small drone airplanes” filled with explosives and guided by GPS equipment. According to the affidavit, in April 2011, Ferdaus expanded his plan to include an attack on the U.S. Capitol. In May and June 2011, Ferdaus delivered two thumb drives to the UCs, which contained detailed attack plans with step-by-step instructions as to how he planned to attack the Pentagon and Capitol. The plans included using three remote controlled aircraft and six people, including himself, whom he described as an “amir,” i.e., an Arabic term meaning leader.

During various recorded meetings, Ferdaus envisioned causing a large “psychological” impact by killing Americans, including women and children, who he referred to as “enemies of Allah.” According to the affidavit, Ferdaus’ desire to attack the United States is so strong that he confided, “I just can’t stop; there is no other choice for me.”

In May 2011, Ferdaus traveled from Boston to Washington, D.C., conducted surveillance and took photographs of his targets (Pentagon and Capitol), and identified and photographed sites at the East Potomac Park from which he planned to launch his aircraft filled with explosives. Upon his return, Ferdaus told the UC that “more stuff ha[d] to be done,” that his plan needed to be expanded, and that he had decided to couple his “aerial assault” plan with a “ground directive.” Ferdaus indicated that his ground assault plan would involve the use of six people, armed with automatic firearms and divided into two teams. Ferdaus described his expanded attack as follows:
...with this aerial assault, we can effectively eliminate key locations of the P-building then we can add to it in order to take out everything else and leave one area only as a squeeze where the individuals will be isolated, they’ll be vulnerable and we can dominate.

Once isolated, Ferdaus planned to “open up on them” and “keep firing” to create “chaos” and “take out” everyone. He also provided the expanded plan to the UC on a thumb drive.

Between May and September 2011, Ferdaus researched, ordered and acquired the necessary components for his attack plans, including one remote controlled aircraft (F-86 Sabre). This morning prior to his arrest, Ferdaus received from the UCs 25 pounds of (what he believed to be) C-4 explosives, six fully-automatic AK-47 assault rifles (machine guns) and grenades. In June 2011, Ferdaus rented a storage facility in Framingham, Mass., under a false name, to use to build his attack planes and maintain all his equipment.

According to the affidavit, in August 2011, the F-86 remote controlled aircraft was delivered to the Framingham storage facility. Ferdaus delivered a total of eight detonation devices to the UCs over the course of the investigation, which he built with the intention that they be used by al Qaeda operatives overseas to kill U.S. soldiers. On September 20, 2011 Ferdaus made a training video, which he provided to the UCs, demonstrating how to make “cell phone detonators.”

According to the affidavit, at today’s meeting the UCs allowed Ferdaus to inspect the explosives and firearms (a quantity of C-4 explosives, three grenades, and six fully-automatic AK-47 assault rifles) that the UCs delivered, and that Ferdaus had requested for his attack plan. After inspecting the components, Ferdaus brought them to his storage unit, took possession of the explosives and firearms, and locked them in his storage unit. Ferdaus was then immediately arrested.

Although Ferdaus was presented with multiple opportunities to back out of his plan, including, being told that his attack would likely kill women and children, the affidavit alleges that Ferdaus never wavered in his desire to carry out the attacks.
.
If convicted, Ferdaus faces up to 15 years in prison on the material support and resources to a foreign terrorist organization charge; up to 20 years in prison on the charge of attempting to destroy national defense premises; and a five-year minimum mandatory in prison and up to 20 years on the charge of attempting to damage and destroy buildings that are owned by the United States, by using an explosive. On each charge Ferdaus also faces up to three years of supervised release and a $250,000 fine.

The case was investigated by the FBI, with assistance from the Worcester, Ashland and Framingham Police Departments and the Bureau of Alcohol, Tobacco, Firearms ,and Explosives.

The case is being prosecuted by Assistant U.S. Attorneys B. Stephanie Siegmann and Donald L. Cabell of Ortiz’s Anti-Terrorism and National Security Unit.

The details contained in the complaint are allegations. The defendant is presumed to be innocent unless and until proven guilty beyond a reasonable doubt in a court of law.

Najibullah Zazi -- a 24-year-old airport shuttle driver who authorities said received explosives and weapons training from al-Qaida during a trip to Pakistan last year -- was charged in New York with conspiracy to use weapons of mass destruction...

Federal investigators probing an alleged bombing plot with suspected ties to al Qaeda are trying to track purchases of chemicals that could be used to make explosives, as three men charged as a result of the probe appeared in court Monday... Two officials familiar with the probe said investigators were combing records on the purchases of chemicals, particularly hydrogen peroxide, that could be used to make bombs. Peroxide-based explosives were used in a deadly attack on London's subway and bus system in July 2005, and al Qaeda's interest in such explosives has been a top concern for the Federal Bureau of Investigation for almost two years, according to intelligence assessments made public...

The Federal Bureau of Investigation arrested three men from Afghanistan on charges of making false statements in connection with a terrorist investigation, according to the Department of Justice... Federal authorities in Colorado arrested Najibullah Zazi, 24, and his father, Mohammed Wali Zazi, 53, the Justice Department said in an e-mailed statement. The third man, Ahmad Wais Afzali, 37, was apprehended in New York... “The arrests are part of an ongoing and fast-paced investigation,” David Kris, assistant attorney general for national security, said in the statement. “It is important to note that we have no specific information regarding the timing, location or target of any planned attack.”...

US forces are "likely" to have killed a top al-Qaeda suspect during a military raid in Somalia, US officials say... They flew helicopters into Somalia and attacked a car they say was carrying Kenyan-born Saleh Ali Saleh Nabhan... US agents have been hunting Nabhan for years over attacks on a hotel and an Israeli airliner in Kenya in 2002... It is believed he fled to Somalia after the attacks and was working with the al-Shabab group, which the Americans see as al-Qaeda's proxy in Somalia...

Palm prints are taken from the scene of a diffused roadside bomb in Iraq. Later, an individual entering a New York airport is arrested on an unrelated charge. A full set of prints are taken during the booking process and submitted to our Next Generation Identification (NGI) system. A positive ID connects the man to the roadside bomb.
.
A ski mask-wearing bank robber leaves with his loot, and witnesses tell police they noticed a red skull tattoo on his hand. A search of NGI’s Interstate Photo System for a red skull tattoo provides a potential candidate list that could ultimately lead to the identification of the bank robber.
.
Both cases are hypothetical, but in the not-too-distant future these scenarios could really happen…thanks to the ongoing development of the
Next Generation Identification system -- a logical evolution of our current Integrated Automated Fingerprint Identification System (IAFIS).
.
That evolution will include not only enhanced fingerprint capabilities but also other forms of biometric identification like palm prints, iris scans, facial imaging, scars, marks, and tattoos -- in one searchable system.
.
Next Generation Identification is…
.
A state-of-the-art identification system that will be “bigger, faster, and better” than IAFIS, says Assistant Director Tom Bush of our Criminal Justice Information Services Division.
.
“Bigger” because it will increase the capacity of our fingerprint storage plus house multimodal biometrics records like palm prints and iris scans…and still have room to accommodate future biometric technologies (i.e., voice, gait, etc.) as they become available and prove reliable.
.
“Faster” because it will speed up response time for high priority criminal ten-print submissions from two hours to about 10 minutes on average. There will also be a special category called the “Repository of Individuals of Special Concern” containing records of known or suspected terrorists, wanted persons, and sexual offender registry names. These records can be quickly searched to help law enforcement in the U.S. and American soldiers in places like Iraq and Afghanistan assess the level of threat during an encounter.

“Better” because going beyond fingerprints as biometric identifiers will enhance the investigative and identification processes. For example, adding palm prints makes sense: some of the latent prints left behind by criminals at crime scenes are palm prints. NGI is also being developed to be compatible with other U.S. biometric systems and potentially with those of some foreign partners.
.
Next Generation Identification is not…
.
A tool to expand the categories of individuals from who the fingerprints and biometric data may be collected, nor will it change existing legal authorities.
.
It doesn’t threaten individual privacy. As required with any federal system, the FBI is doing Privacy Impact Assessments on what information will be collected, how it will be shared, how it will be accessed, and how the data will be securely stored…all in an effort to protect privacy.
.
NGI is not strictly an FBI system. It’s a joint effort and is being developed in full collaboration with its primary users—our local, state, and federal partners…in particular the CJIS Advisory Policy Board and the National Crime Prevention Compact Council.
.
Over the next few years, we’ll be rolling out NGI capabilities incrementally so our partners will have the benefit of each capability as soon as it gets our stamp of approval.

Possible Sighting of FBI Fugitive in British Columbia

Possible Sighting of FBI Fugitive in British Columbia

The FBI is working with Canadian authorities to confirm the possible sighting of one of its Domestic Terrorism fugitives.
.
Last November, the Bureau announced a $50,000 reward for information leading to the arrest of four eco-terrorists known as “The Family.”
.
Rebecca Rubin, one of the four fugitives, was spotted by a tipster who may have seen her near her hometown of Vancouver, British Columbia.
.
We received several tips about all of the fugitives as a result of the publicity.
.
Some of the information was pretty specific about Rebecca Rubin
The FBI is working through its agents assigned to the U.S. Embassy in Ottawa as well as the Royal Canadian Mounted Police to follow up on this information.
Rubin and three other fugitives, Joseph Dibee, Josephine Overaker, and Justin Solondz, are all believed to be living abroad.

It has been 10 years since the group torched a ski resort in Vail, Colorado, causing $26 million in damage and drawing international attention to eco-terrorists—those who break the law in the name of the environment and animal rights.
.
Here are the charges against the four:
.
Dibee was indicted in 2006 on charges of arson, conspiracy, and animal enterprise terrorism. He is believed to be living in Syria with family members.
.
Overaker has been on the run since 2001. She was indicted in 2004, with subsequent indictments in 2006, including for her involvement with the 1998 Vail arson. She is believed to have spent time in Germany and may have settled in Spain. She speaks fluent Spanish.
.
Rubin was indicted in 2006 for the Vail arson and other domestic terrorism crimes. A Canadian citizen, she has strong family ties to Canada and may be living there.
.
Solondz was also indicted in 2006 on charges that include arson, conspiracy, and animal enterprise terrorism. He was out of the country when he was indicted and has never returned. Solondz has traveled in Russia, China, and India.
.
Anyone with information on the whereabouts of any fugitive should contact their nearest law enforcement agency, FBI Field Office, or U.S. Embassy.

The FBI’s fight against terrorism funding paid a big dividend yesterday when five former leaders of a U.S.-based Muslim charity were convicted of funneling more than $12 million to the Palestinian terrorist group Hamas.

Guilty verdicts on all 108 counts against the Holy Land Foundation for Relief and Development were announced in federal court in Dallas, Texas, representing the largest victory against terrorist financing in the U.S. since the 9/11 attacks.

“For many years, the Holy Land Foundation used the guise of charity to raise and funnel millions of dollars to the infrastructure of the Hamas terror organization,” said Patrick Rowan, Assistant Attorney General for National Security. “This prosecution demonstrates our resolve to ensure that humanitarian relief efforts are not used as a mechanism to disguise and enable support for terrorist groups.

The FBI first got involved in the Holy Land case nearly 15 years ago. In 1994, we began looking into the organization’s financial ties to Hamas. During the investigation, our agents traveled the globe to conduct more than 100 interviews, to sort through hundreds of boxes of documents (including many Arabic documents), to view hundreds of video and audio tapes in Arabic, and to review thousands of pages of bank records.

Noting that the FBI's top investigative priority is
counterterrorism, Robert E. Casey, Special Agent in Charge of our Dallas office, applauded yesterday’s verdicts and put terrorists on notice: “The FBI will continue to keep the country safe by actively investigating all forms of terrorist threats, whether that threat manifests itself in the planning or execution of a violent terrorist act or other crimes that provide support to terrorist organizations.”

Fighting terrorism by choking off its funding source is one of the many techniques we use to proactively disrupt and dismantle terrorist enterprises before they strike. The case against Holy Land was investigated by one of our Joint Terrorism Task Forces, which bring together local, state, and federal law enforcement agencies.

In December 2001, three months after the 9/11 terrorist attacks, the U.S. Treasury Department designated Holy Land as a “Specially Designated Terrorist” group. We raided the organization’s Texas headquarters, seized its assets, and shut down its operation. At the time, Holy Land was ranked as the country's largest Muslim charitable organization.

Hamas was designated a terrorist organization by the U.S. in 1995, and that made contributions to the group illegal. The 108 counts the Holy Land defendants were convicted of yesterday, including providing material support to Hamas and money laundering, carry stiff sentences. No sentencing date has been set.

During the trial, the government presented evidence that Holy Land Foundation and the five defendants provided approximately $12.4 million in support to Hamas and its goal of creating an Islamic Palestinian state by eliminating the State of Israel through violent jihad. Evidence was also presented that several of the defendants have family members who are Hamas leaders, including Hamas’s political chief, Mousa Abu Marzook.

FIVE INDICTED FOR MORTGAGE FRAUD

HOUSTON – A federal grand jury sitting in Houston has indicted five individuals in a 12-count indictment with devising a scheme to defraud residential mortgage lenders by misstating facts relevant to the lending decisions, U.S. Attorney Don DeGabrielle, FBI Houston Special Agent-in-Charge Andrew R. Bland III and Rodney E. Clarke, Special Agent-In-Charge of the Houston office of the Internal Revenue Service Criminal Investigations Division (IRS-CI), announced today.

The indictment alleges that Anthony Wayne Hawkins, 48, Brandon Alonzo Crenshaw, 27, Nehemiah Jamal Douglas, 28, Babette Jammer, 47, and David Vasser, 59, engaged in a mail and wire fraud conspiracy which resulted in the defendants and their co-conspirators fraudulently obtaining more than $17 million in loan proceeds. The defendants and their co-conspirators are accused of recruiting individuals to purchase residential properties with the intent to deceive mortgage lenders concerning the borrower’s ability and incentive to repay the loans. According to the indictment, falsified documents were prepared and provided to the mortgage lenders to support loan applications.

“Those who seek to take advantage of the American Dream of home ownership and those who prey upon others in these dire economic times will most certainly be held accountable,” U.S. Attorney DeGabrielle said.

“The FBI remains committed to continuing its efforts to vigorously address mortgage fraud and ensure that the strength and integrity of the nation's financial sector are sustained,” said Bland. “Moreover, it is imperative that those who engage in this pernicious crime, and thereby undermine the economic vitality of our communities, are held fully accountable for their actions.”

“Mortgage fraud, like all financial crimes, threatens the overall health of our financial institutions and erodes the integrity of our tax system,” Clarke said. “Additionally, these types of crimes drive buyers into foreclosure, leave lenders burdened with bad loans and neighborhoods with abandoned and deteriorating properties. IRS Criminal Investigation is committed to working with its law enforcement partners to pursue individuals who commit these types of crimes.”

All five defendants have been arrested by special agents of the FBI and IRS-CI and are expected to appear before a U.S. Magistrate Judge at 2:00 p.m. today. Count one, charging conspiracy to commit mail and wire fraud, and counts two through six, alleging wire fraud, each carry a possible maximum penalty of 20 years in prison and a $250,000 fine.

Hawkins, Crenshaw, Douglas and Vasser are also charged in counts seven through twelve with engaging in monetary transactions with the proceeds of the scheme and the conspiracy to do so. The indictment alleges that bank accounts were opened in business entity names to deposit and transfer the fraudulently obtained loan proceeds. The maximum possible penalty for a conviction under counts seven through twelve is 10 years in prison and a $250,000 fine.

The criminal charges are the result of a joint investigation being conducted by agents of the FBI and IRS-CI. Assistant U.S. Attorney Melissa Annis is prosecuting the case.

An indictment is a formal accusation of criminal conduct, not evidence. A defendant is presumed innocent unless and until convicted through due process of law.

The Justice Department, the FBI, and the U.S. Postal Inspection Service (USPIS) today announced that there have been significant developments in the investigation into the 2001 anthrax mailings, which killed five individuals and injured 17 others. In particular, we are able to confirm that substantial progress has been made in the investigation by bringing to bear new and sophisticated scientific tools.

We are unable to provide additional information at this time. The Department, the FBI, and the USPIS have significant obligations to the victims of these attacks and their families that must be fulfilled before any additional information on the investigation can be made public. In addition, investigative documents remain under court seal. We anticipate being able to provide additional details in the near future.

Additional Information on the Investigation

The investigation known as "Amerithrax" is one of the most complex and comprehensive ever conducted by law enforcement. Over the past seven years, the Amerithrax Task Force, which is comprised of 17 FBI Special Agents and 10 U.S. Postal Inspectors, has executed approximately 75 searches and conducted more than 9,100 interviews in the relentless pursuit of the perpetrator of these attacks.

“Investigations or surveillance of individuals or organizations are predicated on specific standards set in the Department Of Justice Attorney General Guidelines.

“The FBI is the lead agency for investigating violations of federal civil rights laws, and we take that responsibility very seriously. Over the last several years, the FBI has worked to strengthen its relationships with Muslim communities, resulting in many valued partnerships.

“We appreciate the assistance of the community groups for bringing these concerns to our attention. We intend to continue this dialogue.”

Thousands of people are headed to Phoenix this week, but some are not in town to watch the big game. They are there to help protect the players and fans at Super Bowl XLII and related events.

We’re talking about the hundreds of FBI employees and other law enforcement personnel who have converged upon the Valley of the Sun in support of local police and public safety officials.

The Department of Homeland Security has designated the game a level one national security event, which allows federal agencies to bring in resources from across the country. Several federal agencies—including the Bureau of Alcohol, Tobacco, and Firearms; the Federal Emergency Management Agency; the U.S. Secret Service; and the Department of Homeland Security, just to name a few—are in Arizona to do their part. In all, more than 30 federal, state, and local agencies are involved.

Although local authorities are responsible for overall security, the FBI takes the lead in working to prevent terrorist attacks and in gathering, analyzing, and sharing intelligence related to potential threats. In addition to dozens of personnel responding from our Phoenix field office, we’ve sent more than 150 agents, intelligence analysts, bomb technicians, hazardous materials experts, SWAT professionals, crisis negotiators, police, and media representatives from across the country to the scene.

Like the two teams squaring off on Sunday, it has taken us months of planning and teamwork to reach this big day. Good luck to both the Giants and Patriots!

Imagine sitting across from Saddam Hussein every day for nearly seven straight months—slowly earning his trust, getting him to spill secrets on everything from whether he gave the order to gas the Kurds (he did) to whether he really did have weapons of mass destruction on the eve of war (he didn’t). All the while gathering information that would ultimately be used to prosecute the deposed dictator in an Iraqi court.

That was the job of FBI Special Agent George Piro, who told his story Sunday, January 27, on the TV news program 60 Minutes.

Soon after U.S. Special Forces pulled Saddam out of a spider hole on December 13, 2003, the CIA—knowing the former dictator would ultimately have to answer for his crimes against the Iraqi people—asked the FBI to debrief Hussein because of our longstanding work in gathering statements for court.

That’s when we turned to Piro, an investigator on our terrorism fly team who was born in Beirut and speaks Arabic fluently. Piro was supported by a team of CIA analysts and FBI agents, intelligence analysts, language specialists, and a behavioral profiler.

Piro knew getting Saddam to talk wouldn’t be easy. He prepped by carefully studying the former dictator’s life so he could better connect with Saddam and more easily determine when he was being honest. It worked: during the first interview on January 13, 2004, Piro talked about Saddam’s four novels and Iraqi history, which impressed Hussein. Saddam asked for Piro to come back.

From that day forward, everything Piro did was designed to build an emotional bond with Saddam and to get him to talk truthfully. To make Hussein dependent on him and him alone, Piro became responsible for virtually every aspect of his life, including his personal needs. He always treated Saddam with respect, knowing he would not respond to threats or tough tactics. As part of his plan, Piro also never told Hussein that he was an FBI field agent, instead letting him believe, for the sake of building credibility, that he was a high-level official who reported directly to the President.

It took time. Piro spent five to seven hours a day with Saddam for months, taking advantage of every small opportunity that presented itself, including listening to Hussein’s poetry. Eventually, Saddam began to open up.
Among Saddam’s revelations:
* Saddam misled the world into believing that he had weapons of mass destruction in the months leading up to the war because he feared another invasion by Iran, but he did fully intend to rebuild his WMD program.

* Piro told 60 Minutes that Saddam considered Usama bin Laden “a fanatic” and a threat who couldn’t be trusted.

* The former dictator admitted “initially miscalculating President Bush and President Bush’s intentions,” Piro said, thinking the war would be more like the shortened air campaign of the Gulf War.

Saddam never used look-alikes or body doubles as widely believed, thinking no one could really play his part.

Hussein made the decision to invade neighboring Kuwait in 1990 following an insulting comment by one of its emirs.

Piro was so successful at befriending Saddam that the former dictator was visibly moved when they said goodbye. “I saw him tear up,” Piro said during the television interview.

Joe Persichini, Assistant Director in Charge of our Washington office and Piro’s boss, told 60 Minutes that Piro’s expert work in revealing Saddam’s secrets was “probably one of the top accomplishments of the agency in the last 100 years.”
